AML / KYC Statement
Summarises Clause 7 of the General Terms and Conditions, Policy Version 2.0, published and effective 31 August 2026.
1. Introduction
Battrust Investment Bank Limited ("Bank", "we", "us", or "our") is committed to preventing money laundering, terrorism financing, proliferation financing, and other financial crime, in accordance with the anti-money-laundering, counter-terrorism-financing and counter-proliferation-financing ("AML/CFT/CPF") requirements of the Labuan Financial Services Authority ("Labuan FSA") and other applicable law. This statement summarises the client undertakings and Bank actions set out in Clause 7 of our General Terms and Conditions, which remains the governing document; in the event of any inconsistency, the General Terms and Conditions prevail.
2. Client undertakings
By opening an account or using our services, the client confirms and undertakes that:
- All funds, assets, transactions, instructions, and activities connected with the Bank are lawful.
- The client will not use, or permit another person to use, any account or service to facilitate, conceal, support, finance, or benefit from money laundering, terrorism financing, proliferation financing, bribery, corruption, fraud, tax evasion, sanctions evasion, market abuse, or any other unlawful or prohibited activity.
- The client will comply with applicable law and regulatory requirements, including FATCA, CRS, AML/CFT/CPF, targeted financial sanctions, tax reporting, record-keeping, and disclosure requirements.
- The client will promptly provide information, documents, tax self-certifications, waivers, declarations, consents, and other evidence reasonably requested by the Bank.
- Information supplied to the Bank is true, accurate, complete, current, and not misleading.
3. Screening, monitoring and Bank actions
The Bank carries out due diligence, enhanced due diligence, screening, monitoring, investigation, verification, and risk assessment in relation to clients, authorised persons, beneficial owners, connected persons, transactions, funds, assets, and counterparties. To comply with applicable law or regulatory requirements, or to manage risk, the Bank may, without prior notice where permitted:
- Refuse, delay, suspend, cancel, reject, block, reverse, or restrict an application, account, service, instruction, transaction, payment, transfer, or other activity.
- Freeze, earmark, withhold, debit, transfer, or otherwise deal with funds or assets where required or permitted.
- Close or restrict an account or terminate a service.
- Make reports, filings, disclosures, notifications, or responses to an authority or another person.
- Determine the client's tax or regulatory classification based on information available to the Bank.
- Withhold, deduct, debit, or remit taxes, amounts, or assets where required by applicable law.
The Bank is not obliged to disclose the reason for an action where disclosure is prohibited by law, would prejudice an investigation, would amount to tipping-off, or would conflict with a regulatory or legal requirement. Labuan FSA's AML/CFT/CPF and targeted-financial-sanctions materials require screening, and may require a Labuan reporting institution to freeze assets, block a transaction, reject a prospective relationship, and report relevant action when a designated person or related party is confirmed.
4. Tax compliance (FATCA/CRS)
Clients are responsible for understanding and complying with all tax obligations that may apply in any jurisdiction. The Bank does not provide tax advice and is not responsible for a client's tax status, treatment, liabilities, or consequences. The client must notify the Bank in writing within 30 days of any change in tax residency, tax identification number, tax classification, controlling persons, or beneficial ownership previously provided. If requested information or documents are not provided, the Bank may restrict, suspend, or close an account or service; determine the client's status using available information; report information to a relevant authority; or withhold, deduct, or remit amounts as required by law.
